Was the ball over foul ground - yes. Did it touch a player while there? - Yes It's foul. Caught/Not Caught is completely independent of fair/foul. Live/dead on a foul ball IS dependent on caught/not caught, but first you have to know 1) was it fair or foul and 2) was it caught or not.
