Technical for Extra Time Out - maybe?

A referee, who admittedly did not do a very good job by making this mistake, acknowleged a timeout request for a team that didn't have any. Immediately after blowing the whistle and granting the time out, the official realizes it was a spectator directly behind the bench for the team that called for it, not the head coach.

By rule, a time out must be granted when the referee gives it, even if it is a mistake, like when the wrong team has the ball, etc. (If I'm incorrect, let me know)

Also, by rule, a team receives a time out when one is requested, even if they don't have any to use. They then receive an administrative technical foul for the excess time out. (Again, correct me if I'm wrong)

Now - what happens if the time out is granted to a team that doesn't have one, but they didn't actually request it?

I know the referees did a pretty bad job acknowledging a time-out from someone in the stands - but it has happened in the past. What is the best way to handle this situation? It doesn't make sense to penalize the team that didn't have the time-out that you gave them with a technical foul, since it wasn't really their fault they were given one. If a player or head coach, or even an assistant requested it, legally or illegally, it makes sense to penalize them in that case. But in the example I'm asking about, what do you do?

And yes, we know the ref deserves a big smack with a wet noodle - but I'm more concerned with how to handle a situation like this - not that the ref screwed up - we already know that

This is easy. A time out only has to granted if the team or a team member calls the time out. If the official heard someone call a time out and didn't have enough sense to turn around and see who it was calling it and goes ahead and grants a time out. After he/she grants the time out then realizes or finds out that it was in fact someone behind the bench you would just simply put the ball back in play @ the POI. No penalty would be administered.

This case play only applies when someone on the team actually requested the time-out.
5.8.3 SITUATION E: The official erroneously grants Team B a time-out in a situation when Team B cannot have one. What happens now? RULING: Team B is entitled to use the time-out since it was granted. The time-out once granted cannot be revoked and is charged to Team B. All privileges and rights permitted during a charged time-out are available to both teams.

Since the official in the situation you described did not heed the following advice,
2004-05 POINTS OF EMPHASIS
2. Time-out administration.
A. Coaches calling. Coaches must understand that just because they've requested a timeout doesn't guarantee it will be granted. Remember, only the head coach may legally request a timeout from the bench. Officials must be sure that the head coach is making the request. That is best done by hearing the coach, then visually confirming the request by seeing the coach request the timeout. Too often officials use sound only, later to discover the time out request was from someone other than the head coach.

he must now turn to this:
ACCIDENTAL WHISTLE
7.5.4 SITUATION: An official sounds his/her whistle accidentally: (a) while A1 is dribbling and in player control; (b) while Team A is in control and passing among teammates; (c) while A1's unsuccessful try attempt is in flight; or (d) while A's successful try attempt is in flight. RULING: The ball is put in play at the point of interruption. In (a) and (b), Team A is awarded a throw-in at the nearest out-of-bounds spot to where the ball was when the whistle was accidentally sounded. In (c), the ball is put in play by the team entitled to the throw-in using the alternating-possession procedure. In (d), even though, by rule, there is no team control during this dead-ball period, the ball would be given to Team B for a throw-in anywhere along the end line. Team B would have clearly received the ball had the official not accidentally sounded his/her whistle. (7-4-4; 4-12-3,6; 4-36)
