Michael,
A foul FLY BALL or for that matter, LINE DRIVE caught in the confines of the playing field (both fair and foul territory)(non DEAD BALL AREA) is live and in play. The runner has the right to tag up. A grounded foul ball is dead and does not become live unitl the pitcher has the ball on the rubber and the batter is in the box.
