Yes, these bats have been an issue in the past.
The bats in that picture were all of the bats removed from a previous FP National.
To quote someone from the ASA safety and equipment committee:

These bats have had issues since their beginning in the market place. These type of items normally are not brought to the attention of the committee because we have been checking and removing bats from play for many years for various reasons.
