No no no. The head is a small target that is easy to miss. And when you throw it behind him, it's just as dangerous as if it was directly at the helmet. Batter natural movement is to lean back, right into the path of the ball. No way is he getting away with this.

And its for his own good, cause guess what is happening if he gets up to the plate himself again. Try filling out that paperwork...
