With two outs the batter is out, with less than two outs the runner is out and the batter is not penalized.
I think that is backwards. With two outs and the runner trying for HP, the runner is out. I believe in all other situations the batter is out.
7.09d - "Before two are out and a runner on third base, the batter hinders a fielder in making a play at home base, the runner is out."
