I believe the criteria for the ball going over the batter's head ONLY appears in the ASA rulebook with regards to foul tips. If the ball goes over the batter's head, it can NOT be a foul tip.

Nowhere does it say that the ball must go over the batter's head in order to be legally caught for an out.

I think that's where the confusion lies.
