If as you say the defender went straight up, he's not out of position. Everyone is entitled to their spot on the floor provided they get there first legally. Since you don't mention anything about that, if he's there and goes straight up, he has not committed a foul. It's probably best to be a no call as only the official decides if a foul must be called. Unless the defender is knocked backward out of his space and put at a disadvantage, I say no call is the best call.
