MLB Bat

Straight MLB Rules - A batter comes to bat with a Bamboo bat or composite bat.

Would you consider this a Rule 1 violation and just remove the bat or a Rule 6 violation and call him out and eject him?

Rule 6.06(d) only applies to bats that have been tampered with or altered, not noncompliant bats that otherwise meet manufacturer's specs.

...and if they get a hit with such bat there is no penalty, correct?

That's correct, per the Note at the end of rule 1.10(c):

NOTE: If the umpire discovers that the bat does not conform to (c) above until a time during or after which the bat has been used in play, it shall not be grounds for declaring the batter out, or ejected from the game.
