I was wondering if the conceipt of last time by applies in Fed ball. ex: R1, hit and run. Ball hit to shallow center field where center fielder makes a diving catch. R1 in returning to 1st misses 2nd base. Center fielders throw back to 1st goes out of play. When the ball goes out of play R1 is between 1st and 2nd. R1 is awarded 3rd. R1 retouches 1st touches second and proceeds to third. In Fed ball will an appeal of R1 missing 2nd the first time be upheld.

See item 4 of the 2004 BRD. There is no provision for last time by in FED, treat as in OBR. Under OBR - "OFF INTERP 7-4: PBUC Staff: A runner who left a base too soon and missed a subsequent base when returning would still be permitted to retouch in order both bases when accepting his award."

"Play 7-4: R1 moving on the pitch: B1 flies deep to center, and R1 believes the ball will not be caught. He touches second and heads for third, when he learns the ball was caught. Trying to hustle back to first he misses the second. The ball is thrown to dead-ball territory, and hte umpire awards R1 third. Ruling: If R1 touches first, second and third in order, he is not in jeopardy of an out on appeal."

Sounds like the runner in your play, and the case play, touched 2B, "the last time by", which happened during the dead ball award of 3B.
