In a recent game the opposing pitcher was taking the throw back from the catcher with his pivot foot on the pitcher's plate and immediately going into his set position

Would this have helped?

8.05 If there is a runner, or runners, it is a balk when -
(i) The pitcher, without having the ball stands on or astride the pitcher's plate . . .
