 The exception is for a play just like what you describe, a player working for position, receiving the ball, making a move to shoot, and shooting.  The judgement comes in to play when you believe the player is not making that immediate move.  Immediately is the key here

 No.  Violation for going out of bounds illegally.  Rule 9-3-2.
