Obviously the batter is trying to "distract the catcher (similar to a swing to protect the runner) but if its only the bat and the batter is not leaning over the plate I've got nothing. Look at it this way if he tried to bunt and he missed what have you got? Again nothing. Assuming of course he didn't lean over the plate.
