I reread the pertinent rules regarding this situation and "the bird" no matter who it is aimed at should be assessed a flagrant technical foul. Rule 4-19 Art. 4... A flagrant foul.......If technical, it involves dead-ball contact or noncontact at any time which is extreme or persistent, vulgar or abusive conduct.
I would consider this vulgar conduct.
