I have to agree, that judgment comes into play. You need to know the game situation; ie. who is behind in the score, time remaining, etc, before ruling. In most cases, I would lean toward calling an intentional foul, but there are exceptions. For instance, a player reaches to slap the ball away from a dribbler and accidently grabs his/her jersey. In this case, an intentional foul would not be justified. "Intent" is the keyword here.
