New AR 9-1-14 (III) says that if B94 started from outside the frame of the snapper, incidental contact with the snapper is legal. Unfortunately its wording is unclear about whether the tactic you describe (in which apparently the contact with the guard and snapper is simultaneous) is incidental or non-incidental contact. The snapper's head's being down does put him at a disadvantage in preventing a swim move, but such an act doesn't seem to pose the danger that the provision seems to be directed against.
