It wasn't until the ball was entered into the post that the violation was called, so I wonder if he "conveniently" went with the 3 seconds instead of a foul.

If they're not gaining (too much of) an advantage, then give them a chance to get out. But, once the ball is thrown in to the post, be reasonably strict with the call.
