Top 8th WS. Upton stealing 3B, RH batter steps back to block throw and bends over like he is getting out of the way (everybody knows the catcher is going behind the batter to throw to 3B) and catcher has to throw above the batter and throw is bad. I've got nothing but I'm wondering if I've been had?

The concept of the batter tricking everyone into believing he was trying to get out of the way (when he was really trying to interfere) is irrelevant. Intent is not part of this rule.

I dont' think you've been had, but if you do have interference, you can call it. I think most of the time it will depend on the age of the players as to how much leeway the batter is given etc,
